Your privacy is very important to us. PodcastEZ™ provides this Privacy Policy for the www.PodcastEZ.com website (the "Site"), which is comprised of various web pages operated by PodcastEZ™ ("PodcastEZ").  At PodcastEZ™, we are serious about your privacy.  This Privacy Policy is designed to help you understand what information we collect through our website and services (the “Site”), how we may use and disclose such information, and to help you make informed decisions when using the (the “Site”).  By using or accessing (the “Site”), you consent to the practices described in this Privacy Policy.  This document is incorporated as a part of our Website Terms of Use.

COLLECTION AND USE OF YOUR INFORMATION

Our primary goal in collecting your information is to improve our site, services, features and content, administrate your Subscription and Membership, and create an ever-improving user experience.

The information we collect may be "personally identifiable" (meaning it can be used to specifically identify you as a unique person) or "non-personally identifiable" (meaning it can’t be used to specifically identify you). We use both types of information, and combinations of both types, as described below. We may use or store information wherever PodcastEZ™ does business, including countries outside your own.

When you register with PodcastEZ™ and submit personal information to create an account or profile, other users may see your name or other provided information, which may include (but is not limited to): your first and last name, photo, location, email address, email message content, phone number, cookies, usage data, or any personal information provided in your Profile. We may use your Personal Data to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt-out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send or by contacting us.

We do not sell, rent, or lease our subscription lists to third parties, and we will not provide your personal information to any third-party individual, government agency, or company at any time unless strictly compelled to do so by law.

We may also disclose non-identifying information and log data with third parties for analytics, industry analysis, demographic profiling and other purposes to enhance our service, to provide service on our behalf, to perform service-related services or assist us in analyzing how our service is used. The above-mentioned third parties will have access to your personal information in order to perform tasks assigned to them on our behalf. They are under obligation to protect your privacy and not disclose your information for any other purpose. Your personal information is important to us and it will not be shared, except as noted above. 

COMMENTS

Comments left on the site by visitors in the comments form will be subject to data collection, including the visitor’s IP address and browser to assist with spam detection.

REMARKETING

PodcastEZ™ may advertise to you through third party services via remarketing after you have used our Service. We and our third-party vendors use cookies to inform, optimize and serve ads based on your past visits to our Service.

OTHER INFORMATION

We may collect data regarding the type of device you use to access our website.  This information helps us provide a better experience to our Members.  The information we collect may include: the type of device, the operating system, device settings or identifiers for a device crash.  You may check with the manufacturer of your device or software to learn more about the information your device transmits. We may also use third party services such as Google Analytics Demographics and Interest Reporting to obtain information regarding the use of our Platform.

ADDITIONAL FORMS OF DATA COLLECTION: COOKIES/PIXELS 

Like most websites, mobile applications or other Internet applications, we (or our third-party service providers) may use “cookies” or “pixels” to improve your experience on our site.  A cookie is a small data file that we transfer to your computer or mobile device's hard disk for record-keeping purposes.  There are two types of cookies that are utilized:  

A PERSISTENT COOKIE  

This cookie is utilized to save your login information for future logins to the Site.  (This stores your login information but not your password).

SESSION COOKIE

This allows us to confirm that users are logged in (they last until you close your browser) and to enable certain features of the Site, to better understand how you interact with the Site and to monitor web traffic routing on the Site. We do not sell, trade, or otherwise transfer to outside parties your Personally Identifiable Information unless we provide users with notice. This does not include website hosting partners and other parties who assist us in operating our website, conducting our business, or serving our users, so long as those parties agree to keep this information confidential. We may also release information when it’s release is appropriate to comply with the law, enforce our site policies, or protect ours or others’ rights, property or safety.

HOW WE USE COLLECTED INFORMATION

The information you provide may be used by PodcastEZ™ in the following ways:

  •  We may collect information that furthers our efforts to make your Member experience a better one with more pertinent features and content.  
  •  We may send you related services updates, marketing emails, newsletters, information, or general support that matches your interest profile.

We may use the information we collect from you when you register, make a purchase, sign up for our newsletter, respond to a survey or marketing communication, surf the website, or use certain other site features in the following ways:

  •  To personalize your experience and to allow us to deliver the type of content and product offerings in which you are most interested.
  •  To allow us to better service you in responding to your customer service requests.
  •  To send periodic emails regarding your order or other products and services.
  •  To follow up with them after correspondence (live chat, email or phone inquiries)

OPTIONS REGARDING THE INFORMATION PROVIDED BY YOU

You may review, update, correct or delete the Personal Information in your Account by editing such profile in your online dashboard. If you completely delete all such information, then your Account may become deactivated. We will use all reasonable efforts to honor your request. 

  •  You can have your account closed.  You can close your account by sending an email to [email protected].  When you close your account, we will remove your information from the PodcastEZ™ subscription database.  PodcastEZ™ has the right to retain archived copies of your information for legitimate business purposes or under the direction of Law.

YOUR DATA PROTECTION RIGHTS UNDER GENERAL DATA PROTECTION REGULATION (GDPR)

If you are a resident of the European Economic Area (EEA), you have certain data protection rights. PodcastEZ LLC aims to take reasonable steps to allow you to correct, amend, delete, or limit the use of your Personal Data.

If you wish to be informed what Personal Data we hold about you and if you want it to be removed from our systems, please contact us.

In certain circumstances, you have the following data protection rights:

The right to access, update or delete the information we have on you. Whenever made possible, you can access, update or request deletion of your Personal Data directly within your account settings section. If you are unable to perform these actions yourself, please contact us via email to assist you.

The right of rectification. You have the right to have your information rectified if that information is inaccurate or incomplete.

The right to object. You have the right to object to our processing of your Personal Data.

The right of restriction. You have the right to request that we restrict the processing of your personal information.

The right to withdraw consent. You also have the right to withdraw your consent at any time where PodcastEZ LLC relied on your consent to process your personal information.

You have the right to complain to a Data Protection Authority about our collection and use of your Personal Data. For more information, please contact your local data protection authority in the European Economic Area (EEA).

The Website is hosted in the United States. If you are visiting from the other regions with laws governing data collection and use that may differ from U.S. law, please note that you are transferring your personal data to the United States which does not have the same data protection laws as the other regions and by providing your personal data you consent to:

  •  The use of your personal data for the purposes identified above in accordance with this Privacy Policy; and

HOW DO WE PROTECT YOUR INFORMATION?

  •  We do not use vulnerability scanning and/or scanning to PCI standards.
  •  An external PCI compliant payment gateway handles all CC transactions.
  •  We use regular Malware Scanning.
  •  We use an SSL

Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems and are required to keep the information confidential. In addition, all sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology.

We implement a variety of security measures when a user enters, submits, or accesses their information to maintain the safety of your personal information.

All transactions are processed through a gateway provider and are not stored or processed on our servers. 

INFORMATION SHARING AND DISCLOSURE 

We may share your personally identifiable information as follows:

 We will be compliant with Laws and Law Enforcement, including with government and law enforcement officials and private parties to enforce and comply with the law. Information will not be disclosed until we have a good faith belief that an information request by law enforcement or private litigants meets applicable legal standards.  We may employ third party companies or individuals to process personally identifiable information on our behalf in compliance with this Privacy Policy.  Specifically, we may use third parties to facilitate our service, to provide the service on our behalf, to perform site-related services, processing payments for products or services, providing search results, advertisements or links (including sponsored links). In direct correlation to these offerings and business operations, these third-party service providers may have access to your personally identifiable information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.  

 PodcastEZ™ may sell, transfer, or otherwise share some assets, including your personal information, in the event of a merger, acquisition, sale, bankruptcy or reorganization of the company.

Our Site contains links to other websites. If you choose to visit an advertiser by "clicking on" a banner ad or other type of advertisement, or click on another third-party link, you will be directed to that third party's website. The fact that we link to a website or present a banner ad or other type of advertisement is not an endorsement, authorization or representation of our affiliation with that third party, nor is it an endorsement of their privacy or information security policies or practices. We do not exercise control over third party websites. These other websites may place their own cookies or other files on your computer, collect data or solicit personal information from you. SECURITY

We will make any legally required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored "personal data" (as defined in applicable state statutes on security breach notification) to you via email or conspicuous posting on this Site in the most expedient time possible and without unreasonable delay, insofar as consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.

CalOPPA is the first state law in the nation to require commercial websites and online services to post a privacy policy. COPPA (CHILDREN ONLINE PRIVACY PROTECTION ACT)

When it comes to the collection of personal information from children under the age of 13 years old, the Children’s Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, United States’ consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online.

We do not specifically market to children under the age of 13 years old.

FAIR INFORMATION PRACTICES

The Fair Information Practices Principles form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe. Understanding the Fair Information Practice Principles and how they should be implemented is critical to comply with the various privacy laws that protect personal information.

CAN SPAM ACT

We collect your email address in order to:

      • Market to our mailing list or continue to send emails to our clients after the original transaction has occurred.

To be in accordance with CANSPAM, we agree to the following:
